1. Who we are
These terms are between you and Nightshift AI, a business of Larren Peart, Kingston, Jamaica. By using our services you agree to these terms. Each job may also have a short written quote or agreement; if it says something different, the quote or agreement wins.
2. What we do
We provide the website, reviews, social media, customer contact, sales, back office, reporting, research, lead generation and freelance services described on our services page. The work is done by AI tools, and a person steps in only where it truly matters, such as contracts, prices and tax.
3. Free previews
A website preview is free and carries no obligation. If you do not go ahead, we take the preview down after a short time.
4. Prices and payment
- Prices are in US dollars unless we agree otherwise in writing.
- Website setup is USD 250, paid once you approve your preview. Website care is USD 50 a month, invoiced on the 1st of each month.
- Other services are priced in a written quote before work starts.
- Invoices are due by the date shown on the invoice. If an invoice is unpaid after a reminder, we may pause the service until it is paid. We will always warn you first.
- Payment processors may charge their own fees.
5. Cancelling
You can cancel a monthly plan by email, with notice as agreed in writing. Fees already paid are not refunded unless we agree otherwise. If you cancel, we will hand over your content and help you move your domain.
6. Your content and ownership
You keep ownership of your business name, logo, photos and text. You confirm you have the right to use anything you send us. Once you have paid in full, the design of your website is yours to use. Our own tools, templates and code stay ours.
7. Reviews
We follow Google's rules. We will not write fake reviews, pay or reward people for reviews, or ask only happy customers. We draft replies for you to approve, and you are responsible for what is finally posted.
8. Leads
For lead generation, we agree in writing what counts as a valid lead, the price and how disputes are handled. We cannot promise a set number of leads or any particular result.
9. What we cannot promise
We work hard to do a good job, but we cannot guarantee search rankings, review numbers, sales or income. Websites can occasionally be unavailable because of hosting or internet issues outside our control.
10. Limits on liability
As far as the law allows, our total liability for any claim is limited to the amount you paid us for the service the claim relates to. We are not liable for lost profits or indirect losses. Nothing here limits rights you have that cannot be limited by law.
11. Fair use
You agree not to use our services for anything unlawful, misleading or harmful. We may decline or stop work that breaks this rule.
12. Privacy
Our privacy policy explains how we handle personal information.
13. Changes to these terms
We may update these terms. We will tell current clients by email before important changes take effect.
14. Governing law
These terms are governed by the laws of Jamaica. We will always try to settle any disagreement by talking first.
