Privacy policy

How Nightshift collects, uses and protects your personal information.

Privacy policy

Run entirely by AI. A human steps in only when it truly matters.

Questions: [email protected]

The short version

We collect only what we need to reply to you and to do the work you ask for. We never sell your information. You can ask to see, correct or delete it at any time by writing to [email protected].

Who we are

Nightshift AI ("Nightshift", "we", "us") is a business of Larren Peart, based in Kingston, Jamaica. We are the data controller for the personal information described here.

The law we follow

We follow Jamaica's Data Protection Act, 2020. In plain terms, the Act says personal information must be:

  • used fairly and lawfully, and only for clear reasons we tell you about;
  • limited to what we actually need;
  • kept accurate and up to date;
  • kept no longer than needed;
  • handled in line with your rights;
  • kept secure; and
  • sent outside Jamaica only where it stays properly protected.

Where we work with people in other countries, such as the United States, we also respect the privacy and marketing laws that apply there.

What we collect

  • Details you give us: your name, business name, email, phone or WhatsApp number, and your message.
  • Client details: billing details, the content you send for your website, and records of the work we do for you.
  • Leads: if you contact one of the lead sites we run, your name, contact details and the job you need, so we can pass your request to a suitable local business.
  • Website data: technical details such as your IP address and browser type, which our hosting provider records to keep the site secure and working. This website does not use advertising or tracking cookies.

Why we use it

  • To reply to your message and give you a quote. (Your request and your consent.)
  • To deliver and bill for the services you sign up for. (Our contract with you.)
  • To pass a lead to a local business, which you asked for when you sent the request. (Your consent.)
  • To keep our sites safe and improve them. (Our legitimate interests.)
  • To meet tax and legal duties. (Legal obligation.)

How AI is used

Our AI bots read and draft messages, build pages and keep records. They do not make decisions about you that have legal or similarly serious effects without a person checking. You can always ask for a person to review anything we have done.

Who we share it with

We never sell your information. We share it only with service providers that help us run Nightshift, and only as much as they need. These may include website hosting (Cloudflare), our contact form (FormSubmit), email and documents (Google Workspace), record keeping (Airtable), payments (PayPal and WiPay) and phone call routing (Twilio). For lead sites, we share your request with the local business that will do the job.

Sending information outside Jamaica

Some of these providers store information on servers outside Jamaica, mainly in the United States. We choose providers with strong security and contracts that protect your information.

How long we keep it

If you do not become a client, we keep your enquiry only for as long as we need it to reply and follow up. We keep client and billing records for as long as tax law requires. After that, we delete or anonymise them.

Your rights

Under the Data Protection Act, 2020 you can:

  • ask for a copy of the personal information we hold about you;
  • ask us to correct anything that is wrong;
  • ask us to stop using your information, or to delete it, where the law allows;
  • tell us to stop sending you marketing at any time, and we will;
  • ask for a person to review any automated decision; and
  • complain to the Office of the Information Commissioner of Jamaica (oic.gov.jm).

To use any of these rights, email [email protected]. We will reply within the time the law sets and will not charge you for a reasonable request.

Marketing messages

Every marketing email we send includes a clear way to opt out, and we honour opt-outs promptly. We only message people on WhatsApp after they have contacted us first or agreed to it.

Security

We use secure, well-known providers, strong passwords, two-step login and limited access. If a breach affects your information, we will tell you and the Information Commissioner as the law requires.

Children

Our services are for businesses and adults. We do not knowingly collect information from children.

Changes

If we change this policy, we will update the date at the top and, for important changes, let clients know by email.
